1) Eligibility (18+ Only)
The Service is intended for adults 18 years of age or older. By using the Service, you represent you are at least 18.
2) The Service
The Service enables natural-language, voice-based searches about what’s on television and provides recommendations. Results may vary due to factors outside our control (e.g., provider listings, an individual user's particular subscription plan, which may not include specific programs and / or shows suggested by the Service, regional availability, network availability, operating system behavior, or device limitations) any one of which may cause the service to make show, program or other content recommendations that are not offered or not available to you based on your broadcast or specific cable service offering.
3) Accounts
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
4) Free and Paid Plans
The Service may offer free and paid tiers.
Paid subscriptions
If you purchase a subscription, or allow a free subscription to convert to a paid subscription plan you authorize us (and our payment processors) to charge your payment method for applicable fees and taxes. Subscription details, billing frequency, and renewal terms will be displayed at purchase.
Free plan
Free plan users may receive limited features and/or ads.
5) Acceptable Use
You agree not to:
- Misuse the Service, interfere with its operation, or attempt to bypass security
- Reverse engineer or attempt to extract source code except to the extent permitted by law
- Use the Service unlawfully or to violate others’ rights
6) Voice Recording, Transcripts, and Recommendations
By using voice features, you consent to our collection and storage of voice inquiries and creation of transcripts to provide and improve the Service. We analyze inquiries and in-app behavior to deliver recommendations and improve results.
7) Advertising
The Service may display advertisements. We may use your activity within the Service to display contextual and/or behavior-based ads inside the app. We do not sell your personal information, and we do not permit third-party identifiers/tracking tools to collect user identifiers within the app.
8) No Warranty
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9) Compatibility, Bugs, and Device Interference (Limitation)
We have tested the Service for compatibility with commonly used devices and operating systems; however, software may contain unintentional bugs and may behave differently across devices, operating systems, carriers, and configurations.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT USE OF THE SERVICE RELEASES Z&E FROM LIABILITY FOR UNINTENTIONAL BUGS, ERRORS, INTERRUPTIONS, OR INTERFERENCE WITH YOUR DEVICE OR OTHER SOFTWARE ARISING FROM OR RELATING TO THE SERVICE.
10) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
A. Paid plan users
Z&E’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE SUBSCRIPTION FEE PAID BY YOU FOR THE MOST RECENT ONE (1) MONTH OF PAID SERVICE IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
B. Free plan users
IF YOU USE THE FREE PLAN, YOU PAY $0, AND Z&E’S TOTAL LIABILITY WILL THEREFORE BE $0.
C. Exclusion of damages
IN NO EVENT WILL Z&E BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY.
(Some jurisdictions do not allow certain limitations; in that case, the above applies to the maximum extent permitted by law.)
11) Indemnification
You agree to indemnify and hold harmless Z&E from claims, damages, liabilities, and expenses arising from your misuse of the Service or violation of these Terms.
12) Termination and Account Deletion
We may suspend or terminate access if you violate these Terms or if we discontinue the Service.
If you close your account, the Service provides a data deletion button to initiate deletion. Certain information may be retained as allowed or required by law and consistent with our retention practices.
13) Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
14) Arbitration Agreement and Class Action Waiver (READ CAREFULLY)
This section affects your legal rights. It requires individual arbitration and waives class actions and jury trials.
A. Informal resolution first
Before filing a claim, you agree to contact us at admin@zandetechnologies.com with a brief description of the issue and your contact information. The parties will attempt in good faith to resolve the dispute informally for 30 days.
B. Binding individual arbitration
If not resolved, any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by binding arbitration on an individual basis, not in court, except as stated below.
The arbitration will be administered by a reputable arbitration provider (such as AAA or JAMS) under its applicable consumer arbitration rules, as modified by this agreement. Hearings may be conducted remotely, unless the arbitrator determines otherwise.
C. Small claims exception
Either party may bring an individual claim in small claims court if it qualifies and remains in that court.
D. Class action waiver
YOU AND Z&E AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING.
E. Mass/batch arbitration procedure
To promote efficiency, if 25 or more similar arbitration demands are filed against Z&E by the same or coordinated counsel or organization, the parties agree that the arbitration provider may administer the demands in batches and may apply streamlined procedures (including bellwether processes) consistent with provider rules and the goal of efficient resolution.
F. Costs
Arbitration fees and costs will be allocated according to the arbitration provider’s applicable consumer rules and any requirements of law. We will not seek to impose fees on you in a way that would prevent you from bringing a claim.
15) Changes to These Terms
We reserve the right to update these Terms at any time. Changes are effective when posted. It is your responsibility to review the Terms periodically. Continued use of the Service after changes means you accept the updated Terms.
